Iddah For A Pregnant Widow

If an established pregnant women becomes widow, must she observe Iddat of 4 months and 10 days (or whatever it is) before marrying someone else? Her pregnancy is established beyond any doubt visibly, medically (X-rays, Ultra sound, MRI etc.). There will be no doubt that the child she will bear will be from her previous husband. The new husband knows it and is willingly to marry her. Must the widow complete her Iddat period before marrying this man?

Please do not treat the query just perfunctorily. I have given this problem lots and lots of thought. You must also think and ponder over the reasons for ordaining Iddat period, and if the reason is to establish the lineage of the child to come, then in this case it is already established. Hypothetically, the circumstances of the widow are such that there is no one to support her. She doesn't have a home to live in. No money to eat or buy medicine or sustain her. She needs immediate support and help. If she waits for 4 months and 10 days, she will die or the child inside the womb will perish, etc. etc. (Please do not quote, "everything is halal if it can save your life. That doesn't apply here in this case)

In another situation, suppose after 4 months and 10 days it becomes obvious that she is pregnant. Can she marry now immediately after completion of the Iddat period?

And my last question is. Why Iddat was not observed by early Companions? I do not want to go in to details, Khalid bin Walid marrying Laila Malik is one such case in question?

In the western world, it is possible to find out that a child would be produced as down syndrome, which is 100% mental retardation and the whole life he/she has to live as dependant to parents or siblings or government. In case of female child, it is more difficult to take care of such child especially when she is grown up. Sometimes she became pregnant because of sex abuse. It is possible to take care of such children here but not in other 90% third world countries. Even here, they are considered as future burden for financial and social reason as they need a full time supporter whole life. Plight Of An Abandoned Wife

I was married to my husband in September and got pregnant immediately after. He thought the baby was someone else's and he accused me of zinaa without any witnesses and kicked me out over a month ago. I moved back home with my parents in a different state. Since then I have had little to no communication with him. He is not supporting me and my unborn child financially. He continuously slanders my name, threatens me and emotionally abuses me. I know that under the Shari'ah law he is obligated to financially support me until I have my child. However, in his mind he is not my husband anymore. He said, "I will exercise my right to divorce" through a text message without witnesses but it was never said to my face. I do not wish to see or speak to him ever again. How would our divorce go if we don’t even have contact with each other? Also, neither one of us has Muslim family and neither one of us has legally changed our names. He goes by an Islamic name which doesn’t have his father's lineage (he got the name from a Muslim woman he calls Ummi that isn’t actually his mother) and his legal last name comes from his mother. Since neither name that he has contains his father's lineage which last name would I give my baby? Would it be haraam for me to give the baby my last name since he's denying that he is the father?

Abortion

We would like to take help and opinion on an issue that I and my wife are facing. My wife is 40 years old and I am 39. We just found out that Mahallah she is pregnant. We have Mashallah 2 kids, son 12 and daughter who is 6. She got pregnant after almost 6.5 years. Yesterday we found out that she might be carrying twins. Hence we are both in a state of mind whether we would be able to raises 4 kids at this stage of our life. There are following considerations: 1- We are not financially very strong; hence we belong to very average family in this regard. 2- We both work, and my wife contributes to our work. (we live is USA) Major Consideration: 3- I unfortunately suffered a heart attack at the age of 36 and have 4 stents and are on medication. I did suffer from heart damage. Hence in our case the life of mother is not in danger, but it is the increased burden on myself and the stress factor in heart problem, and my fear if God Forbid some thing happens to me, I will leave 4 kids behind which will be much more difficult raising than 2 children. She is only 4.5 weeks in the pregnancy hence no life has been conceived. Given our situation would it be permissible to terminate the pregnancy. Kindly please help us given our situation and guide us as we are faced with this question.
