The Deficient In Reasoning

Allah's Apostle once said to a group of women: 'I have not seen any one more deficient in intelligence and religion than you. A cautious, sensible man could be led astray by some of you.' The women asked: 'O Allah's Apostle, what is deficient in our intelligence and religion?' He said: 'Is not the evidence of two women equal to the witness of one man?' They replied in the affirmative. He said: 'This is the deficiency of your intelligence' ... 'Isn't it true that a woman can neither pray nor fast during her menses?' The women replied in the affirmative. He said: 'This is the deficiency in your religion.'". This hadith seems to confirm what some of the most vocal critics of Islam claim when they say the worth of two female witnesses being equal to one male (in commercial transactions) is proof of Islam's belief that women are intrinsically lacking in intelligence. In other words, the Prophet (SAW) is seemingly confirming that yes, two female witnesses = one male witness IS proof that they are "deficient in intelligence." Please comment.

Plight Of An Abandoned Wife

I was married to my husband in September and got pregnant immediately after. He thought the baby was someone else's and he accused me of zinaa without any witnesses and kicked me out over a month ago. I moved back home with my parents in a different state. Since then I have had little to no communication with him. He is not supporting me and my unborn child financially. He continuously slanders my name, threatens me and emotionally abuses me. I know that under the Shari'ah law he is obligated to financially support me until I have my child. However, in his mind he is not my husband anymore. He said, "I will exercise my right to divorce" through a text message without witnesses but it was never said to my face. I do not wish to see or speak to him ever again. How would our divorce go if we don’t even have contact with each other? Also, neither one of us has Muslim family and neither one of us has legally changed our names. He goes by an Islamic name which doesn’t have his father's lineage (he got the name from a Muslim woman he calls Ummi that isn’t actually his mother) and his legal last name comes from his mother. Since neither name that he has contains his father's lineage which last name would I give my baby? Would it be haraam for me to give the baby my last name since he's denying that he is the father?

Profession Of Faith

What is meant by shahadah (witness) especially in the context of Muslim declarartion of faith. This is usually translated as follows: I bear witness that no-one is worthy of worship but Allah, the One alone, without partner, and I bear witness that Muhammad (pbuh) is His servant and Messenger.

Objections On Islamic Punishments

I am in debate with a non-Muslim lady, who is a well read person. I need to clarify certain issues regarding Islamic punishments, in particular the punishment for fornication. The questions on which I require your answers are:

i. Does the Shari‘ah differentiate between an unmarried, married and a married person who commits adultery while awarding punishment.

ii. In case of a rape victim needing to provide four witnesses to prove her allegations against the rapist, is there any Ijtihad, which makes use of modern medical science (DNA test to confirm identification of the criminal) in absence of failure to produce witnesses?

iii. If no, (that is if the victim fails to prove that she was raped due to absence of such witnesses) would the victim of the rape be punished for qadhf (falsely accusing someone of fornication?
